Welcome to Housing Allowance Helper, an organizing and recordkeeping tool for clergy, operated by Nicholas A. Winnard d/b/a Housing Allowance Helper (“us,” “we,” or “our”).

By creating an account or using the Service, you agree to these Terms and Conditions (“Terms”) and to our Privacy Policy. If you do not agree, do not use the Service.

1. Accounts

You must be at least 18 years old to use this Service. You agree to provide accurate, complete, and current information and to keep your login credentials secure. You are responsible for all activity under your account. Some features require you to verify your email address first.

2. Service and Financial Disclaimer

No Professional Advice.
Housing Allowance Helper provides tools that help clergy and ministry professionals organize, track, and document housing expenses, housing allowance designations, and Fair Rental Value (FRV) estimates. The information, calculations, and reports are for your records only. They are not tax, legal, or financial advice and do not replace a qualified CPA, enrolled agent, or attorney. You are responsible for your own tax decisions and filings.

IRS Publication Reference.
The Service refers to IRS Publication 517 and related clergy housing rules for context. The IRS has not reviewed or approved this application. We do not guarantee that any amount, report, or record will be accepted by the IRS or any other tax authority, and we make no promise about the outcome of any audit.

Third-Party Data.
Property details and rental comparables come from third-party market data providers. They are not an appraisal, and they may be incomplete or out of date.

AI Features.
Some features use artificial intelligence, such as receipt scanning and the in-app help assistant. AI results can be wrong. Review and confirm every AI-generated result before you save it or rely on it.

3. Acceptable Use

You agree not to misuse the Service. For example, you may not scrape it, run automated scripts against it, try to get around usage limits or security controls, resell it, or use it for anything unlawful. We may suspend or close accounts that violate these Terms.

4. Your Data

You own the records you enter and upload. You give us permission to store and process them only as needed to provide the Service, as described in our Privacy Policy. We use trusted infrastructure and follow good practices to protect your data. Still, you are responsible for keeping your own copies of important records, and we recommend exporting your data regularly from the Settings page.

5. Plans, Usage Limits, and Payments

You can use Housing Allowance Helper free of charge. Some features, such as FRV report generation and AI receipt scanning, are part of a paid Pro plan or have usage limits on the free plan. We may change which features are free and adjust usage limits over time. Pro plans have reasonable fair-use limits that protect the Service from abuse.

When paid plans are available, we will show you the price, billing period, renewal terms, and refund policy before you buy. Payments are handled by a third-party payment processor. By subscribing, you authorize recurring charges for the plan you choose until you cancel.

6. Ending Your Account

You may stop using the Service at any time and may ask us to delete your account as described in our Privacy Policy. We may suspend or end your access if you violate these Terms or if we stop offering the Service. If we discontinue the Service, we will give you reasonable notice so you have time to export your data.

7. Indemnification

You agree to indemnify, defend, and hold harmless Housing Allowance Helper, its owner, employees, and partners from any claims, damages, or liabilities arising from your use of the Service, reliance on its calculations, or failure to comply with IRS or state tax laws.

8. Limitation of Liability

In no event shall we be liable for indirect, incidental, or consequential damages resulting from use of or inability to use the Service, including but not limited to tax penalties, interest, back taxes, data loss, or audit findings.

To the maximum extent permitted by law, our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

9. No Warranty

The Service is provided “as is” and “as available.” We make no warranties, express or implied, including but not limited to warranties of accuracy, completeness, or fitness for a particular purpose.

10. Governing Law

These Terms are governed by and construed under the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.

11. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that either party may bring a claim in small claims court if it qualifies.

12. International Users

If you access the Service from outside the United States, you acknowledge that your data will be transferred to and processed in the United States. By using the Service, you consent to such transfer.

13. Changes

We may revise these Terms from time to time. When we do, we will post the new version here with a new “Last Updated” date. If we make significant changes, we will also notify you by email or in the app. If you keep using the Service after the changes take effect, you accept the revised Terms.
